There are as many ways to have a license reinstated as there are to lose a license.  In some states, it is simply a matter of time and once the time for the license suspension has expired, the driver can go to the Department of Motor Vehicles (DMV) and get a new license. A license suspension is separate from a court hearing or ruling.  The Department of Motor Vehicles for the state which issued the license has the sole discretion to determine if and when a suspended or revoked license should be reinstated.

Driving Classes

Some states require an offender to attend a driving class or a safety class and upon proof of completion to the DMV, the offender may receive a new license. If the reason for the suspension is payment of child support or some other monetary fine, an offender may re-apply for a license upon proof of payment.

License Privilege in Other States

A license suspended in one state is considered suspended in all states.  A driver must appeal to the state in which his license was originally issued for reinstatement.  Once a license is reinstated in that original state, it is considered valid in all states.

Suspended Due to DUI/DWI

If a license is suspended due to a DUI (driving under the influence) or a DWI (driving while intoxicated) a driver will have to complete a drug or alcohol addiction program.  Some states have created programs for victims and families of those hurt by DWI drivers.  The drivers listen to the stories of the victims and face the consequences of the pain they caused the victims and their families because they got behind the wheel after drinking.  Some states require participation in a similar program in addition to completing drug and alcohol therapy and education in order to be considered for a license renewal. For these cases, a DUI lawyer can be very effective.

Suspension for Medical Conditions

If a license is suspended due to vision or hearing impairments, proof of a medical exam and corrective lenses or a hearing aid will be needed before a license is reinstated.

Provisional Hardship (Restricted) License

Some states allow for a provisional hardship license under some violation circumstances.  A driver with a suspended license may request a hearing to provide evidence and testimony as to why the license suspension has created an extraordinary hardship.  If a person would lose his job or could no longer get to school, he may be able to convince the DMV to allow his a provisional license.  The provisional license can be revoked immediately, and the penalties will be higher, if the offender receives another violation during the time of the provisional license.
