No Passenger Vehicle Endorsement
Anyone who operates a Commercial Motor Vehicle is required to possess a Commercial Driver’s license. In addition, all bus drivers must have a commercial driver’s license with a passenger endorsement if they operate a vehicle designed to seat 16 or more passengers. To obtain this endorsement, the individual must pass the CDL general knowledge test and the passenger endorsement exam. If the bus has air brakes, they must also pass the air brakes endorsement test. The rules are enforced by Federal, State, and local law enforcement throughout the United States. Violations can lead to written warnings, fines, and other penalties.
Fines and Penalties
There are federal and state laws that affect drivers of commercial vehicles. Violations of these rules can result in both civil and criminal penalties. The Federal penalty for a driver who violates the CDL requirements is a civil penalty of up to $2,500 or in aggravated cases, a criminal penalty of up to $5,000 and/or up to 90 days in jail.
Traffic Points and Impact on Driving Record / License
The penalty for operating a commercial motor vehicle with an improper class license or endorsement will receive a 60-day suspension of their driving privileges. Upon a second conviction, a 180-day suspension will be imposed; and upon a third or subsequent conviction occurring within a 5-year period, a 365-day suspension will apply.
Hiring a Lawyer
Truck drivers are subject to strict regulations by the Department of Transportation (DOT). An experienced attorney can help defend truck drivers charged with DOT violations and other traffic violations that could result in the possible loss of their commercial driving license. If your license has been suspended or revoked, an attorney can help you fight to get in reinstated.
