No Driver’s License
In every state, it is unlawful to operate a motor vehicle when the operator has never been issued a driver’s license from the state department of motor vehicles, or has his or her driver’s license suspended or revoked. As soon as you become a resident of a new state, you must apply for a driver’s license from that state. The time in which you must change your driver’s licenses varies in each state. If you fail to do so within the time allotted by state law, your license from your old home state is invalid and you become an unlicensed driver.
Fines and Penalties
Driving without a license is a criminal offense, and the penalties can be severe depending on the state you are caught driving in. In some states, your vehicle can be impounded for 30 days of even forfeited. The penalty for driving without a license may be punishable by fines ranging from $250 to $1000. The punishment can include imprisonment for up to 6 months. For subsequent or prior offenses, the penalties may include stiffer fines, additional jail time and community service.
Traffic Points and Impact on Driving Record / License
Driving without a license can result in the loss of an individual’s driving privileges and the right to apply for a license can be suspended or revoked by the Department of Motor Vehicles.
Hiring a Lawyer
If you have been cited for driving without a valid driver’s license, you should speak with a criminal defense lawyer to learn about your rights and defenses. An experienced traffic attorney may be able to seek a plea agreement that results in a lesser offense with minor penalties. Your lawyer may even be able to get your violations dismissed.
