When headlamps are not adjusted properly, they often create a glare, distracting other drivers. Certain types of bulbs produce this glare and it is considered a traffic violation. Unfortunately, these types of headlamps often cause accidents and injuries due to distraction and glare. Individuals found guilty of this violation could face heavy fines, and for more than one offense, they could face jail time.
Fines and Penalties
The typical fine for glaring headlamps is between $100 and $250, depending upon the state and whether an accident or injury occurred during the time the individual was cited for the head lamps. If the individual is facing his or her first charge, chances of jail time are unlikely, but with subsequent charges, the fines and jail time length and probability increase.
Traffic Points and Impact on Driving Record
If an individual is found guilty of glaring head lamps, he or she will most likely be given 2 traffic points. This is considered a moving violation and most moving violations require 2 demerit points to be added to the driver’s record. Demerit points can cause many problems for drivers, including suspended driver’s licenses and even increased insurance premiums. In some places, individuals will be unable to get certain jobs because they don’t have a clean driving record. The impact on the driving record is serious considering the assumed triviality of the violation. However, glaring head lamps are dangerous to other drivers and have caused accidents and injuries, making it a dangerous violation.
Hiring an Attorney
If an individual is truly innocent of committing a traffic violation with their head lamps, it is likely that an attorney can submit evidence to the court and prove that fact. He or she may be able to get their client off, having the charges dropped and no penalties given. Attorneys are also more likely to receive reduced charges and smaller fines than individuals are able to receive on their own. Hiring an attorney is a great idea if one has been accused of any moving violation.
Most attorneys offer free consultations, making it easy for individuals to discover their rights and options under the law. This can also make it easier to select the correct attorney to represent you.
