Following Fire Apparatus Too Closely

A very commonly violated traffic law is that no vehicle shall follow a fire apparatus vehicle closer than five hundred feet.  Drivers are not supposed to park near the vehicle either, if the vehicle is on a call.  Violators of this law can receive serious fines and penalties on the first offense, and second or third offenses are always worse.

Fines and Penalties

Most individuals who are found guilty of following fire apparatus too closely will receive a fine of approximately $125. There is a chance that an individual could also receive up to 15 days in jail, or both.  However, most first time offenders will not be given jail time.  For more than one offense, individuals can expect for the fines and jail time to be much harsher, and for each offense, an individual will receive a certain number of demerit points as well.  These points are determined by the kind of violation.

Traffic Points and Defense

The typical number of demerit points an individual will receive for following fire apparatus too closely is 2.  Demerit points are used to determine the safety of a driver, and when too many points are accumulated in a short period of time, the individual could end up losing his or her driver’s license.  The period of time that the individual loses his or her license for depends upon the state, and the severity of the violation.  Any violation where injuries or accidents occur is more serious than violations where none occurred.  When demerit points rise, many insurance companies require the individual to pay higher insurance premiums.

Hiring an Attorney

Individuals accused of following a fire apparatus vehicle should consider hiring an attorney to defend them.  Attorneys are experienced in traffic laws and are the best individuals to present the case of the accused to the court.  Attorneys are often able to receive reduced charges and lesser fees for their clients.  In some cases, attorneys can get the charges dropped so that the individual doesn’t experience higher insurance premiums and a soiled driving record.  With the proper details, an attorney and a good case strategy, innocent individuals can prove to the court that they were not in the wrong.  It’s important to consult with an attorney at the very least, to determine one’s rights and options under the law.
