Endorsement Violation is when you are stopped and found to have no endorsement (proper paperwork) for the CMV which you are operating.  This also includes endorsement for carrying hazardous materials, explosives and other materials.

Fines and Penalties

This is a fairly serious offence and if you are caught twice within a three year period, you could lose your CDL for 60 days. It will be disqualified for 120 days for 3 violations.  Fines may also be imposed at the discretion of the court.  There are other serious violations which count toward the final penalty incurred. Judges have guidelines within which they may impose penalties and fines and they are within their rights to impose the most severe penalties and fines allowable under the law.

Points and Impact on Driving Record/License

Disqualifying a CDL is the most common circumstance of not having proper endorsement. First and second offences usually call for a disqualification of the CDL for 60 days.  That goes up to 120 days for a third offence and the CDL can be revoked if any more violations are added. For serious violations, points are added. Normally, with an endorsement violation, the person has already been stopped for another reason such as speeding. It is after the stop that the endorsement violation is discovered. Each offence will carry its own fine and penalty.
