A controlled access highway refers to a street or highway in which the owners or occupants of abutting land do not have any legal right or are not entitled to access to it. The exception to this are points on the highway that a person is allowed to access as determined by the public authority that has jurisdiction over the highway.

This pertains to pedestrians, bicyclists, or other non-motorized traffic where it is clearly marked that access isn’t permitted.

Although different in every jurisdiction, you could be fined anywhere from thirty dollars up to three-hundred dollars. There could be additional fines for repeat offenses or under extenuating circumstances.

This offence is considered a misdemeanor in most states or a Class 3 traffic offense. In some jurisdictions you may be accessed a number of points on your driving record that will remain there for a certain amount of time.
