Underage drinking and driving carries serious consequences. All states have enacted Zero tolerance policies when it comes to underage drinking and driving. A blood alcohol level of more than 0.0 can result in an underage drinking and driving charge if you are under 21. An adult is considered to be driving under the influence if their blood alcohol level is 0.08. Penalties for underage drinking and driving include but are limited to revocation of driving privileges for 90 days up to 3 years, fines ranging from $100 to $2500 dollars, jail time from 2 days to one year, and 30 to 60 days of community service. A random traffic stop is legal unless an officer has a lawful or reasonable justification for stopping a motorist. Lawful reasons for stopping a motorist include erratic driving that endangers other drivers, defective equipment, missing or invalid license plates.
The laws in this area vary from state to state, consult with a lawyer experienced with traffic violations if you have been stopped for underage drinking and driving or been a victim of a random traffic stop.
