Pursuant to California Vehicle Code Section 23582, a driver may have his DUI charge enhanced if he was driving recklessly, more than 30 mph above the speed limit on a highway, or 20 or more miles above the speed limit on any other highway or street. A reckless DUI driver may face 60 days in county jail. First-time reckless DUI drivers are required to complete either an alcohol and drug counseling and education program or an alcohol or drug counseling and education program. Courts base their finding of reckless DIU driving on the facts as well as on evidence that the defendant was operating a vehicle with a specific amount of alcohol in his blood or under the influence of any drug, alcohol or both.
