Traffic Stop Law

Can a police officer pull you over if he or she just suspects you are breaking the law? Yes! But their behavior on the traffic stop could get your case dismissed. Traffic stop law says the officer must believe you have committed a civil or criminal infraction before pulling you over. A felony traffic stop is when the officer believes the driver is a fugitive or has committed a serious crime. If you are pulled over, the officer does not have to read your Miranda rights to you so anything you can say can be held against you. Contrary to popular belief, cannot search your car unless they have a warrant or just cause. If you do have contraband in your car, if it is in plain sight, the officer can seize it and charge you. This will give the officer "just cause" to search the rest of your vehicle.
