Right Of Way California

As in the case in most states, California right of way laws have the goal of promoting traffic safety by using common sense and courtesy to control traffic flow. Not only must drivers respect the right of way of pedestrians and bicyclists, but drivers must respect the right of way of other drivers by obeying traffic laws, such as stopping at stop signs and responding appropriately to traffic lights. Drivers must always yield to pedestrians, whether they are located at a crosswalk, at an uncontrolled intersection, or an intersection governed by traffic signals and/or signs. There are limitations on a pedestrian's right of way, however. For example, a driver need not wait until a pedestrian has completely crossed a street using a crosswalk before proceeding; a driver can proceed through the crosswalk as soon as it is safe to do so. Likewise, a pedestrian must exercise due care for his or her safety under California law. While a pedestrian enjoys certain right of way privileges, a pedestrian may not put him or herself in danger by unexpectedly stepping into the path of a close, oncoming vehicle, or by unnecessarily stopping or delaying traffic.
