Reckless Driving Speeding

Speeding, or driving faster than the posted speed limit, sometimes results in a speeding ticket, and sometimes results in a reckless driving charge. For instance, if you drive at a rate that is 30 miles per hour over the posted speed limit, you are likely to be charged with reckless driving; however, if the police officer finds that you exceeded the speed limit by five miles per hour or less, you potentially could receive only a speeding ticket, or even a verbal or written warning in some circumstances. While moderate speeding along will not constitute reckless driving, moderate speeding combined with other reckless acts related to driving such as swerving, sideswiping another vehicle, and running traffic lights could result in a reckless driving charge under some states' laws. Likewise, a person who was not speeding, but also committed other traffic violations, might still be charged with reckless driving. Furthermore, in some states, speeding at any rate creates a presumption of recklessness. Nonetheless, you can rebut, or prove that the presumption is untrue, by showing that you did not drive in a reckless manner.
