Pedestrian Right Of Way

Under most state laws, a pedestrian generally enjoys the right of way over a vehicle when crossing a street. In recent years, lawmakers have acted to strengthen pedestrian right of way laws in response to increased reports of reckless driving and injured pedestrians; in some states, vehicles must not only take care to yield to pedestrians, but also to completely stop for pedestrians crossing the street or roadway in certain circumstances, such as when pedestrians are attempting to cross using a clearly marked crosswalk. Despite these strong protections for pedestrians under most state traffic laws, there are limitations on a pedestrian's right of way. A pedestrian is required to cross a street or roadway within the bounds of a crosswalk, whether it is marked or unmarked. If a pedestrian does cross within a crosswalk, he or she may violate the law, as well as risk serious injury from being struck by oncoming traffic.
